Virginia Ignition Interlock DUI Laws
Your license is automatically suspended for six days when you are arrested for a DUI in Virginia. This is true whether you refuse to take a breathalyzer test, or do submit to a test and return a blood alcohol concentration (BAC) of .08 or greater.
If you are convicted of a DUI 1st offense, the court will require that you have an ignition interlock device installed on at least one vehicle, as well as any vehicles you operate. This will be a condition of your restricted driving privileges.
Virginia is serious about drunk driving. If you are convicted of Driving While Intoxicated (DWI) in Virginia, your license will be revoked. A revocation is the complete termination of your privilege to operate a motor vehicle in the Commonwealth of Virginia.
Once you comply with the terms of your revocation, as part of your reinstatement requirements, you will be required to take all applicable knowledge and skills tests and pay for a new license.
Multiple DUIs in Virginia
If you are convicted of a DUI 2nd offense within ten years or convicted of a DUI 3rd or subsequent offense within ten years, the court will require that you have an ignition interlock device installed on every vehicle you own, co-own or operate as a condition of restricted driving privileges or full restoration of driving privileges.
After a Virginia DUI conviction, you’ll be required to install an ignition interlock device in a driver’s vehicle in order to obtain a restricted driving license.
