It is common to hear how driving is a privilege, not a right, which is why once you cross the legal line with drinking and driving, you can be denied that privilege by the court. With a car breathalyzer or ignition interlock requirement, however, you still get to drive your own car and are able to be as independent as possible, despite your DUI conviction. West Virginia requires an ignition interlock device for some first-offense DUIs and for all repeat offenses within 10 years, and if you are ordered to use the device, you don’t want to take another chance and lose your driving privileges for good.
West Virginia’s Alcohol Test and Lock program monitors each time you start your vehicle with the ignition interlock device attached, as well as any information from your “rolling re-tests,” the time you start your car and when you turn it off. If the device is tampered with or otherwise circumvented, that information is collected, as well, and sent to your agency reporting service.
Maintaining your eligibility in the program is simple, especially since your main requirements are to stay sober when driving, use the device as directed and to check in with your ignition interlock service provider every 30-60 days. Keep in mind that you will be removed from the program automatically for the following violations:
- Driving a vehicle without an ignition interlock device.
- Any arrest for driving under the influence of any substance.
- Circumventing, bypassing or tampering with the ignition interlock device.
- Not participating in or completing the West Virginia DUI Safety and Treatment Program.
Even after a DUI conviction, there is a certain level of understanding how important the freedom to continue driving is. Most of the time, a DUI is the result of a poor choice, and as long as you’re compliant with the requirements of your ignition interlock program, there is no need for anyone to worry about your sobriety behind the wheel. Maintaining your eligibility in the program proves your own commitment to making positive changes in your life, and by using the ignition interlock device as required, you’ll be able to overcome your mistake quickly, with as much independence, freedom and privlilege you can give yourself.
